Chapter 7 Fresh Start

Start over with no debt and keep your property in most situations.  Stop garnishments, collection actions, lawsuits and judgment collection.  Depending on how much you owe, the type of debts involved, and your income, a Chapter 7 bankruptcy (straight bankruptcy) may eliminate most of your debt.  Bankruptcy allows the debtor to get a fresh start on his or her finances, without the burden of an overwhelming debt load. Usually a person will file bankruptcy when it appears he or she has little or no hope of ever being able to repay their outstanding debts.  Credit card debt and most other debt may be discharged, and the creditor can no longer send you bills or call you for the purpose of collection. 

While most debts can be discharged through a Chapter 7 filing some may not be such as:

  • child support
  • some court orders of family court
  • tax obligations
  • injuries caused to others due to drug use or alcohol use
  • student loans
  • criminal fines and restitution
  • debts or judgments due to fraud
